§ 30-6. Time filing for candidacy.

  • (a)

    Each candidate for any of the elective offices to be filled at such election shall announce their candidacy therefore by filing a statement of intention of candidacy with the municipal election commission no earlier than 12:00 noon on July 15 of the year of the election or, if July 15 falls on Saturday or Sunday, not later than 12:00 noon on the following Monday. The filing period will end at 12:00 noon on August 15 of the year of the election or, if August 15 falls on Saturday or Sunday, not later than 12:00 noon on the following Monday. The statement of intention of candidacy shall list the candidate's information in the following form:

    I hereby file notice that I am a candidate for election to the office of Mayor/Councilmember for District ____________ in the regular/special Municipal Election to be held ____________ . I certify that I am a qualified elector and resident of the City of Greer and the District for which I seek election.

    (b)

    If the filing period closes on a state holiday, then filing must be held open until 12:00 noon on the succeeding weekday. If the date of an election falls on a state holiday, it must be set for the next succeeding Tuesday.

    (c)

    The municipal election commission must submit the properly completed statement of intention of candidacy form to the state ethics commission no later than five days after filing has closed. No statement of candidacy shall be accepted without the payment by the candidate of the applicable filing fee, and said fee shall be paid to the municipal clerk at the time of filing.

    (d)

    In accordance with state law all candidates filing forms with the state ethics commission must file electronically. The state ethics commission public disclosure and accountability reporting system is available for the electronic filing of campaign disclosure forms and financial disclosure forms.

    (1)

    Statement of economic interest form. The State Ethics Act requires candidates to file a statement of economic interests form at the time of becoming a candidate and provide evidence of such filing with the municipal clerk. If a candidate fails to electronically file the statement of economic interest at the time of filing as a candidate, his name shall not appear on the ballot.

    (2)

    Campaign disclosure form. The candidate is also required to file a campaign disclosure form electronically with the state ethics commission in accordance with state law. Failure to file the required form(s) electronically will result in a late filing penalty.
