§ 30-3. Nonpartisan runoff elections.

  • (a)

    The city hereby adopts the nonpartisan election and runoff election method prescribed in S.C. Code 1976, § 5-15-60 et seq.

    (b)

    The first Tuesday after the first Monday in November in odd-numbered years, a municipal election shall be held for the purpose of electing councilmembers, each of whom shall serve a term of four years, and until their successors are elected and qualified; provided that councilmembers elected from wards 2, 4 and 6 shall be elected once every four years and councilmembers from wards 1, 3 and 5, and the mayor, shall be elected every four years on alternate election days so that there shall be staggered terms of office. Each commissioner of public works shall be elected on the first Tuesday after the first Monday in November for a six-year term such that one commissioner is elected every two years.

    (c)

    The six councilmember offices shall be designated by numbered seats such as Seat No. 1, Seat No. 2, Seat No. 3, Seat No. 4, Seat No. 5, and Seat No. 6. The boundaries of the wards and precinct lines shall be those on an official map duly adopted by the city council and later approved by the U.S. Department of Justice in May, 2002; the map is on file in the office of the municipal clerk and is incorporated herein by reference. No person may be a candidate for any numbered seat unless he is a qualified elector residing within the same numbered election district. A candidate for city council shall be elected by the qualified electors of the ward in which he resides. Councilmembers must reside in the ward from which elected throughout the entire term. The term for councilmembers and the mayor shall run from January 1 after the November in which elected to December 31 four years after the November in which they were elected.

    (d)

    A second election shall be held two weeks later for each office for which no candidate receives a majority of the votes cast. The second election shall be between the two candidates receiving the highest number of votes who did not withdraw from the election.
